AI Voice Call Terms

Short version.
When you submit a form asking us to help you find or buy a car, you agree we can call the phone number you gave us, including with an AI-generated voice, about your request. We’ll say up front that it’s DealerKey Auto, and where the law requires it, the AI will say it’s an AI. Say “stop calling me” on any call, reply STOP to any text, or email us and we’ll honor it immediately.
1. What this covers
These AI Voice Call Terms govern outbound phone calls DealerKey Auto (“DealerKey,” “we,” “us”) places to a phone number you provide through dealerkeyauto.com, a Meta/Facebook Instant Form, or any other DealerKey lead form (the “Site”). Calls may be placed by a human team member or by an automated system using a synthetic, AI-generated voice (a “Voice Assistant”) acting on DealerKey’s behalf. 2. Your consent to be called
By submitting a lead form on the Site or a DealerKey Instant Form on Facebook or Instagram, you affirmatively consent to receive outbound phone calls from DealerKey at the phone number you provided, about your vehicle search, using an automatic telephone dialing system and/or an artificial or prerecorded voice — including a Voice Assistant — as those terms are used in the Telephone Consumer Protection Act (47 U.S.C. §227) and FCC rules. This is your prior express written consent to that calling method for wireless numbers.
Consent to be called is never a condition of purchase. You can still work with DealerKey by SMS, email, or by calling us yourself at /contact without agreeing to receive AI or automated calls.
3. What happens on the call
Every DealerKey call, human or automated, identifies DealerKey Auto by name in the first moments of the call and explains why we’re calling (your inventory search, comp/valuation results, or a scheduling follow-up).
AI disclosure. Where required by law — including for callers located in California under Cal. Pub. Util. Code §2874 (AB 2905), which requires that an artificial voice on an automatic dialing-announcing device be disclosed — a call placed by a Voice Assistant will expressly state that you are speaking with an artificial intelligence system at the outset of the call. You may ask any DealerKey Voice Assistant at any time whether you are speaking with an AI, and it will answer truthfully.
Recording disclosure. Some calls may be recorded for quality, training, and dispute-resolution purposes. Where state law requires the consent of all parties to a recorded call, we will disclose that the call is being recorded before recording begins.
4. When we call
DealerKey places outbound calls only between 8:00 AM and 9:00 PM in your local time zone, consistent with FCC/TCPA calling- hour guidance. We limit outbound attempts about a given inquiry and stop entirely once you answer a call, book a time with us, ask us to stop, or opt out.
5. Opt-out
You can withdraw consent to be called at any time, by any reasonable means, including:
- Telling the Voice Assistant or DealerKey team member on the call “stop calling me” or “remove my number”;
- Replying STOP to any DealerKey text message (calling and texting share one do-not-contact list);
- Emailing dallin@dealerkeyauto.com or calling +1 (435) 266-4166.
We honor opt-outs promptly and will not place another automated or AI voice call to that number afterward.
6. TCPA compliance
DealerKey’s outbound calling program is operated to comply with the Telephone Consumer Protection Act and FCC implementing rules, including the FCC’s February 2024 declaratory ruling that calls using AI-generated voices are “artificial voice” calls subject to the same consent requirements as prerecorded calls. We maintain an internal do-not-contact list shared across calling and texting and honor opt-out requests without requiring a specific format.
7. Privacy
Call audio, transcripts, and outcome data are processed by DealerKey’s calling sub-processors (Twilio, Inc. and ElevenLabs, Inc.) in the United States, and handled under the same principles as the rest of your data. Full detail at /legal/privacy.
8. Changes
We may update these AI Voice Call Terms at any time. The updated terms will be posted here with a new “Last updated” date; material changes affecting an active engagement will also be communicated by email or SMS.
